General provisions

  1. This privacy policy (hereinafter referred to as Politics) is intended to inform you about how UAB Somus, legal entity code 302581190, address Joachimo Lelevelio g. 6A, Geležių k., LT-14168 Vilnius district (hereinafter – UAB Somus or We), processes your personal data, as well as your rights when UAB Somus processes personal data.
  2. This Policy has been prepared in accordance with:
    • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the GDPR);
    • The Law of the Republic of Lithuania on the Legal Protection of the Person (hereinafter referred to as the ADTAĮ);
    • The Law of the Republic of Lithuania on Electronic Communications (hereinafter referred to as the EMU);
    • other legal acts regulating the protection of personal data. 
  3. UAB Somus aims to implement the following fundamental principles related to the processing of personal data with this Policy:
    1. Personal data must be processed lawfully, fairly and transparently in relation to the data subject (principle of lawfulness, fairness and transparency);
    2. Personal data must be collected for specified, explicit and legitimate purposes and not further processed in a manner incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered incompatible with the initial purposes (purpose limitation principle);
    3. Personal data must be adequate, relevant and only those necessary for the purposes for which they are processed (principle of data minimisation);
    4. Personal data must be accurate and, where necessary, kept up to date; all reasonable steps must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay (principle of accuracy);
    5. Personal data must be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods if the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes, after implementing appropriate technical and organisational measures necessary to safeguard the rights and freedoms of the data subject (principle of storage limitation);
    6. Personal data must be processed in such a way that, by applying appropriate technical or organizational measures, appropriate security of personal data is ensured, including protection against unauthorized or unlawful processing of data and against accidental loss, destruction or damage (principle of integrity and confidentiality);

Where does UAB Somus receive personal data from?

  1. We obtain your personal data in the following ways:
    • When you provide them to us yourself, e.g. by writing, calling, visiting us, submitting documents, registering on the UAB Somus website
    • From publicly available sources such as websites, social networks
    • Cookie Help. A specific list of cookies used is provided in the cookie management window (Cookie Banner).

 

To whom can UAB Somus transfer your personal data?

  1. UAB Somus ensures the confidentiality of your personal data and does not transfer it to third parties, except for UAB Somus' trusted partners (IT service providers, hosting service providers, email service providers, analytics service providers, couriers, lawyers, financial accounting service providers and other partners), without whom UAB Somus would not be able to carry out its business activities and obligations.
  2. These partners may use your personal data only to the extent necessary to perform the relevant task and are subject to strict confidentiality and data protection requirements.
  3. In certain cases, UAB Somus may have to disclose your personal data to state institutions, such as law enforcement institutions, STI, SODRA, etc.
  4. UAB Somus processes your personal data within the territory of the Republic of Lithuania, however, in certain cases we may transfer personal data outside the EU or EEA, in accordance with the requirements set out in Chapter V of the GDPR.

    Right to access data

    Explanation

    Jūs turite teisę gauti iš mūsų patvirtinimą, ar mes tvarkome Jūsų asmens duomenis. Jei tokie duomenys yra tvarkomi, Jūs turite teisę susipažinti su jais ir gauti informaciją apie tvarkymo tikslus, duomenų kategorijas, gavėjus, saugojimo laikotarpį bei savo teises.

    Taip pat Jūs turite teisę prašyti, kad pateiktume tvarkomų asmens duomenų kopiją (už kiekvienos kopijos pateikimą galime imti pagrįstą mokestį). Kopija bus pateikta, jeigu tai neprieštaraus kitų asmenų teisėms ir laisvėms.

    Right to request correction of data

    Explanation

    Jūs turite teisę reikalauti, kad netikslūs duomenys apie Jus būtų nedelsiant ištaisyti.

    Atsižvelgiant į tvarkymo tikslus, taip pat galite reikalauti papildyti neišsamius asmens duomenis.

    The right to request erasure of data („right to be forgotten“)

    Explanation

    Jūs galite reikalauti ištrinti savo duomenis, jei jie nebėra reikalingi tikslams, kuriais buvo surinkti, arba jei atšaukėte savo sutikimą ir nėra kito teisinio pagrindo duomenims tvarkyti.

    Ši teisė taip pat taikoma, kai duomenys tvarkomi neteisėtai arba kai nesutinkate su duomenų tvarkymu ir nėra viršesnių teisėtų priežasčių juos tvarkyti.

    Tačiau ši teisė netaikoma tam tikrais atvejais, pavyzdžiui, kai būtina laikytis teisinių prievolių arba pareikšti, vykdyti ar apginti teisinius reikalavimus.

    Right to restrict data processing

    Explanation

    Jūs turite teisę prašyti apriboti duomenų tvarkymą šiais atvejais:

    1. Jūs užginčijate duomenų tikslumą, kol UAB Somus patikrina jų tikslumą.
    2. Duomenų tvarkymas yra neteisėtas, tačiau Jūs nenorite jų ištrinti ir vietoj to prašote apriboti jų naudojimą.
    3. Mums nebereikia duomenų jų tvarkymo tikslais, tačiau jie reikalingi Jums siekiant pareikšti, vykdyti arba apginti teisinius reikalavimus.
    4. Jūs pagal BDAR 21 straipsnio 1 dalį paprieštaravote duomenų tvarkymui, kol bus patikrinta, ar mūsų teisėtas interesas yra viršesnis už Jūsų priežastis.

    Right to data portability

    Explanation

    Jūs turite teisę gauti savo pateiktus asmens duomenis susistemintu, įprastai naudojamu ir kompiuterio skaitomu formatu.

    Taip pat galite reikalauti persiųsti šiuos duomenis kitam duomenų valdytojui, jei tai techniškai įmanoma.

    Ši teisė taikoma, kai duomenų tvarkymas grindžiamas sutikimu arba sutartimi ir vykdomas automatizuotomis priemonėmis.

    The right to disagree

    Explanation

    Jūs turite teisę bet kada nesutikti, kad Jūsų duomenys būtų tvarkomi viešojo intereso labui arba siekiant mūsų teisėtų interesų.

    Tokiu atveju nutrauksime duomenų tvarkymą, nebent įrodysime, kad turime teisėtą interesą, kuris yra viršesnis už Jūsų interesus.

    Jei duomenys tvarkomi tiesioginės rinkodaros tikslais, Jūs turite teisę bet kada tam prieštarauti, ir tokie duomenys tokiu tikslu nebebus tvarkomi.

    2. by sending a written request or by visiting UAB Somus at the address Joachimo Lelevelio g. 6A, Geležių k., LT-14168 Vilnius district;
  2. When submitting an application upon arrival at the UAB Somus office, for the purpose of establishing your identity, you must provide an employee of UAB Somus with an identity document. If the application is submitted by e-mail, it must be signed with a qualified electronic signature. In the event that you send the application to the address of the registered office of UAB Somus, a copy of the identity document certified by a notary, or a copy of this document certified in another manner established by legal acts, must be submitted with the application.
  3. UAB Somus undertakes to respond to your request within 1 month from the date of its receipt. This deadline may be extended for another 2 months, if necessary, taking into account the complexity and number of requests. UAB Somus has the right not to respond to your request if the requirements set out in paragraph 12 of the Policy are not met.
  4. Where the data subject's requests are manifestly unfounded or disproportionate, UAB Somus has the right to charge a reasonable fee, taking into account the administrative costs of providing the information or notifications or taking the action requested, or to refuse to take action on the request.
  5. In cases where you believe that your personal data is being processed unlawfully or your rights related to data processing are being violated, you have the right to file a complaint with the supervisory authority (in Lithuania - To the State Data Protection Inspectorate).
